The Burning Sun Scandal: Analyzing Legal Failures in South Korea"

The Burning Sun Club, co-owned by Senungri, a famous K-pop idol part of the Big Bang, was established in February 2018. The club was advertised as “the most elegant and finest club” in South Korea. It was known to consist of the classiest men. However, it was not open to the public. To get in, you must either be an insanely wealthy man with connections or a pretty, slim woman. 


The scandal first came to light when a man named Kim Sang-Kyo reported to the public that he had witnessed a woman being dragged by a VIP member at the Burning Sun Club; however, when he tried to intervene, he was beaten up and arrested. Following his statements, a few other women felt comfortable enough to raise their voices and speak about their experiences. However, no official alteration would be made until the phone of the phone of Jung Jon Young, a singer, songwriter, actor, and TV personality, was discovered. 


In September 2016, Jung Jon Young left his phone with a forensic company during an investigation, and three years later, an anonymous user with access decided to leak all the information. His phone contained a popular messaging app known as KakaoTalk. The app consisted of a chatroom with Seungri, Choi Jonghum, and others. The chats from Jung's phone revealed that there was a hidden sex-trafficking ring taking place in the Burning Sun Club. The exchange of messages involved videos and pictures of women unconscious, being gang-raped, or being bid on. What's even crazier is that the chatrooms didn't just consist of popular idols; some messages implied that a senior police contact was protecting the Burning Sun Club.


Unsurprisingly, it was discovered that Burning Sun employees had actually all been in on the sex trafficking ring. Many would lure women requested by the VIPs to a private room and drug them for tips. A former employee of Burning Sun stated that gamma-hydroxybutyrate was a common narcotic used in private rooms. GHB is a nervous system depressant that causes the user to fall unconscious for several hours. It can also cause amnesia, meaning that after taking the drug, it may be hard to remember what happened during the time you were unconscious or beforehand. 


Seungri served one year in prison and six months for pimping, gambling, and prostitution. Jung spent five years in prison for gang rape. Choi served two and a half years in prison. After serving such small sentences, today they are roaming free, including the high-ranking police official affiliated with Burning Sun, who was acquitted of all charges.


Even though this case occurred around 2020, its impact on several South Korean women is still unknown globally. Furthermore, the case highlights the South Korean justice system's corruption, lack of trust in legal institutions, media influence on legal outcomes, and lack of victim protection. This case truly questions how reforms can be made to laws, police, and clubs in South Korea for the betterment of their citizens and nations.
